Eligible Offenses

Below is a list of eligible violations, this is not an exhaustive list. If your violation is not listed below (and is also not on the ineligible list), you must contact the Prosecutors Office Infraction Deferral Program at 317-770-8860

MOVING VIOLATIONS

6-month program with fee of $192.50

(The Bureau of Motor Vehicles designates these as two-point tickets)

  • 1-15 mph over posted speed limit
  • Failure to signal  
  • Illegal parking on interstate
  • Bumper height violation
  • Muffler violation
  • Improper lights, reflectors or warning signals
  • Motorcycle equipment violations
  • Operating motorcycle without headlight    
  • Failure to use headlights
  • No brake or signal lights
  • Improper parking


9-month program with a fee of $222.50

(The Bureau of Motor Vehicles designates these as four-point tickets)

  • 16-25 mph over posted speed limit
  • Improper pass on right
  • Driving left of center
  • Illegal or improper u-turn, u-turn on interstate ( depends on situation)
  • Unsafe start or unsafe lane movement or unsafe vehicle
  • Disregarding traffic control signal, lighted signal
  • Improper lane usage
  • Improper turn at intersection
  • Failure to dim headlights
  • Failure to obey signs or markings
  • Permitting a minor to operate a PWC
  • Double-line violations
  • Distracted driving


12-month program with fee of $252.50                          

(The Bureau of Motor Vehicles designates most of these as six-point tickets)

  • Operating without financial responsibility INFRACTION ONLY
    • Note: proof of insurance required throughout your program. (This is a mandatory 3 month license suspension by the Indiana Bureau of Motor Vehicles that also could carry a reinstatement fee of up to $350.00. Call the deferral clerk for more information on this offense)
  • Disregarding automatic signal
  • Disregarding stop/yield sign
  • Improper passing on left
  • Following too closely
  • Any failure  to yield tickets
  • Disobeying RR Crossing
  • Failing to stop-railroad crossing
  • Ignoring RR-X-ing stop sign
  • Driving while suspended (Infraction only, which is an eight-point ticket)
  • Speeding in construction zone or work zone ( ONLY IF WORKERS NOT PRESENT)



NON-MOVING VIOLATIONS

12-month program for NON-MOVING Violations with a fee of $182.00

(The Bureau of Motor Vehicles designates these as zero-point tickets)

  • Possession of Paraphernalia INFRACTION ONLY
    • Defendants are required to submit to a drug/alcohol evaluation 45 days of signing the deferral agreement then provide proof of completion of all required counseling.
    • The defendant will also be required to submit a urine drug screen upon enrollment, results must be negative. (This is a Class A Infraction that could carry up to a $10,000.00 fine).
  • Minor-Aid/Induce Possession of Alcohol
    • Defendants are required to submit to a drug/alcohol evaluation within 45 days of signing the deferral agreement then provide proof of completion of all required counseling.(This is a Class C Infraction that carries up to a $500.00 fine).
  • Throwing lit material from a moving vehicle. (This is a Class A Infraction that could carry up to a $10,000.00 fine).


9-month with a fee of $152.00      

(The Bureau of Motor Vehicles designates these as zero-point tickets)

  • Equipment violation
  • Expired driver’s license or license plate
  • False/Fictitious registration
  • Handicapped parking violation
  • Littering
  • Parking violation
  • Failure to sign registration


3-month program with a fee of $92.00

(The Bureau of Motor Vehicles designates this as zero-point ticket)

  • Seatbelt violation on driver only  (***child restraint violations are not eligible)
