PUBLIC HEARING ON A PRELIMINARY RECOMMENDATION TO AWARD PUBLIC-PRIVATE AGREEMENT/SCOPING AGREEMENT PURSUANT TO INDIANA CODE 5-23-5-9v
This notice is to inform the general public of a public hearing that will be held by the Hamilton County Board of Commissioners (the “Commissioners”) on March 27, 2023 at 1:00 p.m. (the “Public Hearing”) at the Hamilton County Courthouse, 1 N. 8th St., Noblesville IN 46060. On January 30, 2023, the Commissioners of Hamilton County, Indiana (the “County”) published a notice, in accordance with IC 5-3-1, of the request for proposals/qualifications (the “RFPQ”) for a Public-Private Agreement (as defined in IC 5-23-2) related to constructing, operating, transferring, and developing of a new public safety accessibility point, emergency management center, and childcare facility (the “Project”) pursuant to Indiana Code 5-23. The purpose of the Public Hearing is to hear the preliminary recommendation of the County’s BOT Evaluation Committee’s (the “Committee”) to the Commissioners to award a public-private agreement/scoping agreement (collectively, the “Agreement”) to an offeror that is proposing to design, construct, operate and transfer the Project to the County pursuant to Indiana Code 5-23.
Based upon the Committee’s preliminary recommendation, the Commissioners, or their designated representatives, intend to negotiate with the offeror recommended by the Committee and may, subject to completion of all requirements required under Indiana Code 5-23, eventually enter into an Agreement with the offeror recommended by the Committee to design, create the appropriate masterplans, construct, and provide other professional services with respect to the Project. The Commissioners intend to pursue, negotiate, and finalize a guaranteed maximum price with the recommended offeror.
The Committee has made a preliminary recommendation to award the Agreement to BW Development (the “Developer”). The Developer scored the highest amongst the other offerors responding to the RFPQ and the Committee placed a heavy emphasis on the Developer’s experience with similar projects. The Committee will provide a more in-depth explanation of the basis upon which the preliminary recommendation is being made at the Public Hearing. All of the proposals received for the Project and an explanation of the basis upon which the preliminary recommendation is being made are available for public inspection and copying in the Hamilton County Auditor’s Office (acting on behalf of the Commissioners) during regular business hours.
